§1. General provisions
- The Online Store is run by the Service Provider.

- To the extent that the Regulations apply to services provided via an IT system ensuring the processing and storage, as well as sending and receiving data via telecommunications networks in accordance with the Act of 18 July 2002 on the provision of services by electronic means, the Regulations are the regulations referred to in Article 8 of that Act.

- Registration requires completing an interactive form, in particular providing true and correct data, by following the messages displayed on the Store Website during Registration.
- To create a User Account, it is necessary to provide your personal data marked as mandatory; it is also possible to provide additional optional data.
- By registering, a person who is not a natural person and creates a User Account declares, under pain of legal consequences, that he or she is authorized to act on behalf of such User, including to make declarations and incur obligations, and to effectively conclude Sales Agreements in accordance with the Regulations.
- Upon activation of the virtual "Create an account" button or similar, an indefinite contract is concluded between the User and the Service Provider for the provision of electronic services in the form of maintaining a User Account and, optionally – if the option to receive it is selected – also the Newsletter service. The terms of providing the Newsletter service are described later in these Terms and Conditions.

- The User Account contains information provided by the User during Registration. Logged-in Users have access to and can modify their data.
- The User is obliged to update the data stored in the User Account.
§ 6. Orders
- The information contained on the Store Website does not constitute an offer from the Service Provider within the meaning of the Civil Code, but only an invitation to Users to submit offers to conclude a Sales Agreement.
- The User may place orders in the Online Store via the Store Website 7 (seven) days a week, 24 (twenty-four) hours a day, subject to prohibitions or restrictions arising from mandatory provisions of law. Orders are processed on Business Days.
- A User placing an Order via the Store Website completes the Order by selecting the Products they are interested in. Products are added to the Order by selecting the "Add to Cart" button or similar button under the relevant Products displayed on the Store Website.
- In the following Product sections, the User selects the payment method for the Order and enters, confirms or modifies the contact details for the delivery of the Products and the delivery method:
- Name, surname and email address,
- Contact telephone number,
- Delivery address.
- After completing the entire Order and selecting the Delivery and payment method in the Shopping Cart, the User places the Order by submitting the Order Form to the Service Provider, selecting the "Buy and Pay" button in the Store or a similar button on the Website. Each time before submitting the Order to the Service Provider, the User is informed of the total price for the selected Product and Delivery, as well as any additional costs they are required to incur in connection with the Sales Agreement.
- The User is obligated to carefully and correctly complete the Order form and provide contact information, including the correct address to which the Goods are to be delivered. The Service Provider will contact the User immediately if this information proves incomplete, using the contact details provided in the Order form or during Registration. If, despite due diligence, the Service Provider is unable to contact the User for reasons beyond their control, and this situation persists for 7 (seven) days from the date the Service Provider attempts to contact the User, the Service Provider's Website reserves the right to cancel the Order and, if the Sales Agreement has already been concluded, to withdraw from the Sales Agreement. The Service Provider may submit a declaration of withdrawal from the Sales Agreement in the case referred to in the preceding sentence within 30 (thirty) days from the date of conclusion of the Sales Agreement.
- During the Order placement process, until the “Buy and pay” button is activated, the Buyer has the option to modify the Order on the Website.
- Each time before sending the Order, the Buyer is presented with a summary of the Order for confirmation purposes, i.e. the main features of the service and the total price including the price of the Products and the cost of their delivery.
- Placing an Order means that the User submits to the Service Provider an offer to conclude a Sales Agreement for the Products covered by the Order.
- After placing an Order, the Service Provider will immediately send an Order Confirmation to the email address provided by the User. Immediate Order Confirmation means that the User is bound by the submitted offer to conclude a Sales Agreement; however, it does not mean that the Service Provider has accepted the offer. The User is bound by the offer for the period specified in paragraphs 15-16 below.
- Payments for the Order are accepted in advance. If the User fails to pay for the Order within 5 (five) days of receiving the Order Confirmation, the Service Provider will cancel the placed Order (rejection of the User's offer) and will not send the Order Confirmation (no Sales Agreement concluded).
- If the User does not receive Order Confirmation within 3 (three) Business Days of the Service Provider receiving payment for the Order, the User is no longer bound by the submitted offer to conclude a Sales Agreement. Until Order Confirmation is received, the Order may be canceled by the User. To do so, the User should contact the Service Provider.
- If the User fails to pay for the Products within 5 (five) days of receiving the Order Confirmation, the User's offer referred to in paragraph 12 shall cease to be binding and the Service Provider shall cancel the placed Order.
- The Service Provider will send an Order Fulfillment Confirmation to the email address provided by the User, provided that the Order can be fulfilled. Confirmation of Order Fulfillment is the Service Provider's declaration of acceptance of the offer referred to in paragraph 13 above.
- The sales agreement is concluded upon sending the Order Confirmation to the email address provided in the Order. The Order Confirmation is sent to the User within 3 (three) days of the Service Provider receiving payment for the Order.
- Confirmation of Order Fulfillment constitutes confirmation to the Buyer of the terms of the concluded Sales Agreement.
- If the Order cannot be fulfilled, the Service Provider will not send the Order Fulfillment Confirmation and will immediately inform the User about this fact – no later than within 3 (three) days of receiving the payment for the Order – and will refund the payment made by the User for the Order within 7 (seven) days of informing the User about the impossibility of fulfilling the Order.
- The content of the concluded Sales Agreement is recorded, secured, and made available by sending an electronic document confirming the terms of the concluded Sales Agreement to the email address provided in the Order. Buyers with User Accounts also have access to these accounts after logging in to their User Accounts.
-
Order processing begins once payment is received by the payment provider. Standard processing time is up to 1 business day from payment confirmation, with packages shipped no later than the next business day.
Products marked with an asterisk (*) have an extended lead time and are shipped within 14 business days.
The standard delivery time (i.e. from the moment the shipment is handed over to the Supplier to its delivery to the Buyer) is 1–2 business days.
In the event of delays due to reasons beyond our control, we reserve the right to extend the delivery time by an additional 7 business days.
- As part of the process of placing and fulfilling Orders, messages regarding the Order are sent to the Buyer's e-mail address.
- Buyers are advised that the Products presented in the Online Store are collector's items and that their daily use (e.g., wearing) may affect their condition and value. It is recommended that they be stored in a manner consistent with their intended use.
§ 7. Payments
- The prices on the Store Website displayed next to a given Product are gross prices and do not include information on Delivery costs and any other costs that the Buyer will be obliged to incur in connection with the Sales Agreement, which the Buyer will be informed about when selecting the Delivery method and placing the Order.
- The sales price for the ordered Products can be paid by payment card (Mastercard, Visa) via an external transfer payment system operated by Wirecard AG (in this case, the execution of the Order will begin after the Service Provider sends the Order Confirmation to the Buyer and after the Service Provider receives information about the payment made by the Buyer from the Wirecard system).
§ 8. Delivery
- The Service Provider carries out Delivery worldwide.
- Products are delivered in the manner selected by the Buyer from among the options available in the Online Store.
- The cost of Product Delivery is borne by the Buyer. This cost is calculated based on the Delivery prices specified in the Order form and is added to the Product's sales price in the summary after the Buyer selects the Delivery option.
- Delivery is ordered by the Service Provider to the Supplier.
- The Service Provider publishes information on the Store Website about the number of Business Days needed for Delivery and execution of the Order.
- The Service Provider is obliged to deliver the Products covered by the Sales Agreement free from defects.
- The ordered Products are delivered to the Buyer via the Supplier to the address indicated in the Order Form.
- On the day the Products are shipped to the Buyer, information confirming shipment is sent by the Service Provider to the Buyer's e-mail address.
- The Buyer should inspect the shipment of Products in a timely manner and in a manner appropriate for that type of shipment. If any loss or damage is detected, the Buyer has the right to request that an employee of the Supplier prepare an appropriate report.
- For each Product sold, a sales document is issued and delivered to the Buyer in the form of an invoice sent electronically to the Buyer's e-mail address.
- If the Buyer is not at the address they provided as the Delivery Address when placing the order, the Supplier's employee will leave a delivery note or attempt to contact them by phone to arrange a time when the Buyer will be present. If the Supplier returns the ordered Goods to the Service Provider, the Service Provider will contact the Buyer by email or phone to re-agree with the Buyer on the delivery date and cost.
§ 9. Complaints and liability of the Service Provider

A Customer who is a Consumer has the right to file a complaint if it is found that the purchased product does not comply with the contract, has a manufacturing defect or was damaged during delivery.

Complaints are reviewed within 14 calendar days of receipt. The customer will be notified of the outcome of the complaint via email.
-
The product being complained about should be returned complete, with the original packaging (if applicable) and proof of purchase.

-
Complaints will not be accepted regarding natural wear and tear of materials resulting from the passage of time, improper use, improper care or mechanical damage caused by the Customer.
-
In the case of purchases made by entrepreneurs (B2B transactions), warranty claims are not available. Pursuant to Article 558 §1 of the Civil Code, the seller's liability under warranty to entrepreneurs is excluded. Purchases made on a VAT invoice issued to a business are not subject to the consumer complaint procedure.
-
Any complaints submitted by entrepreneurs will be considered only within the scope of any individual arrangements concluded between the parties.
§ 10 Withdrawal from the contract by the Consumer
-
A Customer who is a Consumer has the right to withdraw from a distance sales contract within 14 calendar days of receiving the product. The condition for accepting a return is that the product is in the same undamaged condition as when shipped.
-
To make a return or file a complaint, the Customer must complete the appropriate return or complaint form available on the store's website. The form should be sent electronically to info@n-hype.com
or via message on Instagram @n_hype_. -
After receiving and positive verification of the application, the funds will be returned to the Customer's account within 14 days from the date of acceptance of the return.

- The User may express prior consent to receive the Newsletter and other commercial information within the meaning of the Act of 18 July 2002 on the provision of electronic services. For these reasons, access to the User Account and Services is blocked for the time necessary to resolve the issue that led to the blocking of access to the User Account and Services. The Service Provider will notify the User of the blocking of access to the User Account and Services by sending an email to the address provided by the User in the registration form.
